IRCC Updates For International Students

IRCC has made many recent changes to the Canadian International Student Program from study permit caps to post-graduation work permits (PGWP) and spousal open work permits (SOWP). Marc Miller, the Minister of Immigration, Refugees and Citizenship, introduced many new measures to protect international students from exploitation. The new update may seem confusing to the concerned international students. To ensure clarity for you, we’ve outlined all the policy changes made in 2024.

1. Study Permit Cap

In 22nd January 2024, the Canadian government announced a temporary cap of two years on study permits. This means that only about 606,250 new study permit applications will be accepted in 2024, leading to an estimated approval of 360,000 study permits.

To ensure fairness, individual provinces and territories have set caps based on population size. In other words, the provinces having the most study visa enrollment will experience a significant reduction but on the other hand, other provinces and territories will now have higher study permits granted.

However, renewals of existing study permits won’t be affected. Similarly, master’s and doctoral degree programs, as well as elementary and secondary education, are also unaffected.

The IRCC will allocate portions of the cap to each province and territory, which will then distribute them to designated learning institutions (DLI).

2. PAL

In order to implement the Cap policy, most new post-secondary international students at the college or undergraduate level applying for a study permit to the IRCC will require a provincial attestation letter (PAL) from the respective province and territory. These letters are issued to students by each province and territory by March 31, 2024.

These measures are temporary for two years, and the acceptance of new study permit applications in 2025 will be reviewed at year-end. During this time, the Canadian government will collaborate with provinces, territories, designated learning institutions, and national education stakeholders to develop sustainable solutions for international student intake, including establishing a recognized institution framework, determining long-term sustainable levels of international students, and ensuring adequate student housing at post-secondary institutions.

According to a notice from IRCC shared on February 5 and then updated on February 27, here’s who needs PALs and who doesn’t:

PALs are needed by:

  • Most people applying for a study permit for post-secondary education.
  • Most students enrolling in programs that don’t award degrees, like certificate programs and graduate diplomas.
  • International students who aren’t part of the exception list mentioned below.

PALs are not needed by:

  • Students pursuing master’s or doctoral degrees. 
  • Students studying at a Designated Learning Institution (DLI) or PGWP eligible institutions in Canada as part of a visit or exchange program.
  • Students in Canada with study permits or work permits (including those applying for extensions).
  • Students attending primary and secondary school.
  • Family members of study permit or work permit holders in Canada.
  • Students who have already been approved for a study permit and plan to come to Canada for an upcoming program.
  • Students who submitted their application before 8:30 a.m. EST on January 22, 2024.

To get a PAL, students will first receive LOAs, and (once they have committed to attending that specific school), DLIs will then request PALs on the student’s behalf to the provincial government. All the provinces and territories will share and implement the process for providing PALs to international students by 31st  March 2024.

3. PGWP

A post-graduation work permit (PGWP) is a type of work permit given to international students after they complete their studies in Canada. With this permit, students can work anywhere in Canada for any employer without limits on the number of hours.

The length of a post-graduation work permit depends on the level and duration of the study program, as well as the expiry date of the student’s passport. Whichever comes first will determine the duration of the permit.

As of February 2024, there have been some changes regarding the PGWP eligibility for foreign students. The good news is that graduates from master’s programs now qualify for a 3-year post-graduation work permit, even if the course duration is less than two years, provided they meet all the other PGWP eligibility criteria.

Changes have been introduced regarding the eligibility for Post-Graduation Work Permits (PGWPs) for programs offered through public-private partnership college programs. These changes restrict PGWP availability for programs where public colleges license their curriculum to affiliated private colleges. Existing students are still eligible, but new students enrolling in these programs won’t qualify for a PGWP.

4. SOWP

The Spousal Open Work Permit (SOWP) is a permit that allows the spouse or common-law partner of a foreign student in Canada to work in Canada for the duration of their partner’s study or work permit. IRCC recently announced that for spouses who have applied before March 19, 2024, you are eligible for a SOWP if you are eligible for PGWP, have a valid study permit, and are a full-time student at a public college or University or CEGEP in Quebec, or a private college-level school in Quebec, or a Canadian private school authorized to grant degrees under provincial law.

Starting March 19, 2024, open work permits are limited to spouses or common-law partners of international students enrolled in master’s and doctoral programs. SOWP is also eligible for students in certain professional programs like:

  • Bachelor of Science in Nursing (BScN, BSN, BNSc)
  • Bachelor of Education (B. Ed.)
