Latest IRCC Updates For International Students
IRCC has made many recent changes to the Canadian International Student Program from study permit caps to post-graduation work permits (PGWP) and spousal open work permits (SOWP) for students trying to study in Canada. Marc Miller, the Minister of Immigration, Refugees and Citizenship, introduced many new measures to protect international students from exploitation.
If you are planning to study in Canada from Nepal, staying informed about the recent IRRC updates and changes in rules is vital. Here are some of the major changes made by Canadian government to study in Canada.
1. Study Permit Cap
On 22nd January 2024, the Canadian government announced a temporary cap of two years on study permits. This means that only about 606,250 new study permit applications will be accepted in 2024, leading to an estimated approval of 360,000 study permits.
To ensure fairness, individual provinces and territories have set caps based on population size. In other words, the provinces having the most study visa enrollment will experience a significant reduction but on the other hand, other provinces and territories will now have higher study permits granted.
However, renewals of existing study permits won’t be affected. Similarly, if you apply to study in Canada from Nepal for master’s and doctoral degree programs then it won’t affect you.
The IRCC will allocate portions of the cap to each province and territory, which will then distribute them to designated learning institutions (DLI).
2. PAL
For applying to study in Canada from Nepal, students must have a PAL in order to implement the Cap policy. Most new post-secondary international students at the college or undergraduate level applying for a study permit to the IRCC will require a provincial attestation letter (PAL) from the respective province and territory. These letters are issued to students by each province and territory by March 31, 2024.
These measures are temporary for two years, and the acceptance of new study permit applications in 2025 will be reviewed at year-end. During this time, the Canadian government will collaborate with provinces, territories, designated learning institutions, and national education stakeholders to develop sustainable solutions for international student intake, including establishing a recognized institution framework, determining long-term sustainable levels of international students, and ensuring adequate student housing at post-secondary institutions.
Furthermore, according to a notice from IRCC shared on February 5 and then updated on February 27, here’s who needs PALs and who doesn’t:
PALs are needed by
- Most people applying for a study permit for post-secondary education.
- Most students enrolling in programs that don’t award degrees, like certificate programs and graduate diplomas.
- International students who aren’t part of the exception list mentioned below.
PALs are not needed by
- Students pursuing master’s or doctoral degrees.
- Students studying at a Designated Learning Institution (DLI) or PGWP eligible institutions in Canada as part of a visit or exchange program.
- Students in Canada with study permits or work permits (including those applying for extensions).
- Students attending primary and secondary school.
- Family members of study permit or work permit holders in Canada.
- Students who have already been approved for a study permit and plan to come to Canada for an upcoming program.
- Students who submitted their application before 8:30 a.m. EST on January 22, 2024.
To get a PAL, students will first receive LOAs, and (once they have committed to attending that specific school), DLIs will then request PALs on the student’s behalf to the provincial government. All the provinces and territories will share and implement the process for providing PALs to international students by 31st March 2024.
In 2024, Immigration, Refugees, and Citizenship Canada (IRCC) introduced significant policy updates to manage the growing international student population and protect students from exploitation. These changes are crucial for prospective students, including those planning to study in Canada from Nepal, as they reshape the rules around study permits, work opportunities, and institutional accountability. Below is a detailed breakdown of the latest updates:
3. Financial Proof Requirements
Increased Threshold: International students wanting to study in Canada from Nepal now need atleast CAD 20,635 in a Guaranteed Investment Certificate (GIC) to prove they can cover living expenses, reflecting higher costs of living in Canada.
4. Post-Graduation Work Permit (PGWP)
Eligibility Update: Graduates of master’s programs are now eligible for a three-year PGWP, even for programs under two years, provided other criteria are met.
Also Read: PGWP Eligible courses for international students in Canada (Updated 2024)
Restricted Access: Students in private-public partnership programs are no longer eligible for PGWPs.
Language Proficiency: Applicants for PGWPs from non-degree or non-research programs must meet a minimum CLB 7 or equivalent IELTS score of 6.5.
The Canadian government has revised its Post-Graduation Work Permit (PGWP) eligibility criteria to address labor market needs and enhance program integrity. These changes aim to align international students’ contributions with high-demand fields while reducing misuse of the program. Here are the key updates:
Focus on High-Demand Occupations: The PGWP is now primarily designed to support graduates who can fill labor shortages in critical sectors like healthcare, technology, agriculture and engineering.
Students in programs outside these areas may face reduced eligibility. After studying in Canada from Nepal, graduates from master’s and doctoral programs are prioritized under the new criteria. These programs offer an advantage because of the high Comprehensive Ranking System (CRS) points awarded under Canada’s Express Entry system. Master’s graduates receive 135 points, and PhD graduates get 150 points when applying for permanent residency (PR).
Private Institutions Exclusion: Students from private-public partnership institutions are no longer eligible for PGWPs. This move aims to streamline the system and ensure it benefits those attending recognized institutions.
Revised Work Duration Rules: PGWP validity will now depend on the relevance of the program to Canada’s economic needs. Graduates from non-research and short-duration programs might see restrictions on their work permit durations.
Implications for Permanent Residency: The changes aim to provide a smoother path for PR to those with Canadian work experience in essential fields, as such experience is often a prerequisite in PR pathways like Express Entry and Provincial Nominee Programs.
These updates encourage students to focus on programs that address Canada’s labor shortages, ensuring a balance between meeting economic needs and maintaining program fairness. For international students, especially those planning to study in Canada from Nepal, these changes highlight the importance of selecting programs that align with high-demand sectors.
5. Spousal Open Work Permits (SOWP)
Limited Eligibility: SOWPs are now restricted to spouses of students enrolled in master’s, doctoral, or professional programs (e.g., medicine, engineering, pharmacy). Applications submitted before March 19, 2024, are grandfathered under previous rules.
The Spousal Open Work Permit (SOWP) is a permit that allows the spouse or common-law partner of a foreign student in Canada to work in Canada for the duration of their partner’s study or work permit. IRCC recently announced that for spouses who have applied before March 19, 2024, you are eligible for a SOWP if you are eligible for PGWP, have a valid study permit, and are a full-time student at a public college or University or CEGEP in Quebec, or a private college-level school in Quebec, or a Canadian private school authorized to grant degrees under provincial law.
Starting March 19, 2024, open work permits are limited to spouses or common-law partners of international students enrolled in master’s and doctoral programs. SOWP is also eligible for students in certain professional programs like:
- Bachelor of Science in Nursing (BScN, BSN, BNSc)
- Bachelor of Education (B. Ed.)
- Bachelor of Engineering (B. Eng., BE, BASc)
- Bachelor of Law or Juris Doctor (LLB, JD, BCL)
- Pharmacy (PharmD, BS, BSc, BPharm)
- Doctor of Medicine (MD)
- Doctor of Optometry (OD)
- Doctor of Veterinary Medicine (DVM)
- Doctor of Dental Surgery (DDS, DMD)
6. Work Off-Campus Regulations
New Limit: Students can work up to 24 hours per week off-campus during academic sessions, increased from the previous 20-hour limit. Full-time work remains permitted during scheduled breaks.
7. Institutional Accountability and Compliance
Stricter DLI Oversight: Designated Learning Institutions (DLIs) must submit bi-annual reports confirming that enrolled students comply with study permit conditions.
Consequences: DLIs that fail to report compliance may be suspended from admitting new international students for up to a year.
8. Changing Designated Learning Institutions (DLIs)
As of November 15, 2024, IRCC has announced that if an international student in Canada decides to transfer to another institution, especially one not previously declared in their original study permit application, they now need to apply for a new study permit and receive approval before making this change.
- Previously, students could change DLIs without needing a new study permit, provided the new institution was on the list of eligible DLIs.
- This change ensures better oversight and discourages misuse of the student visa system, such as transferring to less-regulated or unapproved institutions.
Exchange Programs:
Students coming to Canada as part of an exchange program might not require a new study permit approval if their visa conditions already allow participation in such programs. However, the new rule emphasizes clear documentation and prior approval to maintain program integrity.
Why These Changes Matter?
Canada’s updates aim to ensure fair distribution of international students across provinces, prevent misuse of immigration programs, and align labor market needs with education pathways. For students planning to study in Canada from Nepal, understanding these policies is crucial to navigating the application process successfully.
Staying informed, preparing financial proof, securing a PAL (if needed), and complying with work hour regulations are essential steps for a smooth transition. For more information, visit IRCC’s official website or consult with experts at Canadian Study Center offices.
